Welcome to AfroSocial (“Platform,” “we,” “our,” or “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use AfroSocial.


1. Eligibility

1A. Parental Consent for Minors (Ages 16–17)

If you are between 16 and 17 years old, you may only use AfroSocial with permission from a parent or legal guardian. By creating an account, you confirm that:

  • They consent to your use of the Service.

  • They accept responsibility for your activity on the platform.

  • Error-free operation

11. Limitation of Liability

To the maximum extent permitted under Delaware law, AfroSocial, its owners, officers, directors, employees, partners, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, service interruption, computer damage, or system failure, arising out of or related to:

  • Your use or inability to use the Service

  • User content

  • Unauthorized access to accounts or data

  • Third‑party conduct or services

In no event shall AfroSocial’s total liability for all claims relating to the Service exceed the greater of:

  • The amount you paid us, if any, in the past 12 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless AfroSocial, its parent company, affiliates, officers, directors, employees, contractors, agents, licensors, and partners from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Your violation of any law or third‑party rights

  • Your content or conduct on the platform

  • Any dispute between you and another user

AfroSocial reserves the right to assume exclusive defense and control of any matter otherwise subject to indemnification, and you agree to cooperate with our defense of such claims.


13. Platform Liability Protection (Section 230 Notice)

You acknowledge that AfroSocial is an interactive computer service provider and is not the publisher or speaker of user‑generated content. To the fullest extent permitted by applicable law, AfroSocial shall not be held liable for content posted, transmitted, or shared by users. We reserve the right, but not the obligation, to remove content at our discretion.


14. Force Majeure

AfroSocial shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, internet outages, power failures, or technical infrastructure failures.


15. Virtual Items & Digital Goods

If AfroSocial offers virtual goods, subscriptions, badges, or digital items:

  • They have no cash value unless explicitly stated.

  • They are licensed, not sold.

  • They may be modified, revoked, or discontinued at any time.

  • Purchases are non‑refundable except where required by law.

AfroSocial reserves the right to manage, regulate, control, modify, or eliminate digital goods at its sole discretion.


13. Copyright & DMCA Policy

AfroSocial respects intellectual property rights. If you believe content on the platform infringes your copyright, you may submit a notice including:

  • Your contact information

  • Identification of the copyrighted work

  • URL or location of the infringing content

  • A statement of good‑faith belief of infringement

  • A statement under penalty of perjury that your claim is accurate

  • Your signature (physical or electronic)

We may remove allegedly infringing content and terminate repeat infringers.


14. Dispute Resolution & Arbitration

Any dispute arising from these Terms or use of the Service shall first be resolved through informal negotiation. If unresolved, disputes shall be settled by binding arbitration in Delaware, United States, except where prohibited by law. You waive the right to participate in class‑action lawsuits or class arbitrations.

18. Business Accounts & Advertising

If you create a business, promotional, or advertiser account:

  • You represent that you have authority to act on behalf of the entity.

  • You agree that promotional content must be truthful and lawful.

  • Paid promotions, sponsorships, or advertisements must be clearly disclosed where required by law.

  • AfroSocial may reject or remove advertisements at its discretion.

We are not responsible for transactions or agreements between users and advertisers or businesses on the platform.
